Eser s\u00f6zle\u015fmelerindeki temerr\u00fct i\u00e7in \u00f6zel bir d\u00fczenleme olmad\u0131\u011f\u0131 i\u00e7in genel temerr\u00fct h\u00fck\u00fcmleri uygulan\u0131r.  BK. 117-119 ve 123-125 maddeleri uygulanacakt\u0131r.<\/p>\n<p>Arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmeleri gibi her iki tarafa bor\u00e7 y\u00fckleyen s\u00f6zle\u015fmelerde, bor\u00e7lu borcu \u00f6demede temerr\u00fcde d\u00fc\u015ft\u00fc\u011f\u00fcnde, alacakl\u0131 \u00fc\u00e7 se\u00e7imlik hakka sahip olur ve bunlardan sadece birini tercih ederek kullanabilir. S\u00f6z konusu haklar;<\/p>\n<p>&nbsp;<\/p>\n<p>\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>S\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan borcun aynen ifas\u0131n\u0131 ve gecikme i\u00e7in tazminat isteme hakk\u0131,<\/strong><\/p>\n<p>\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>S\u00f6zle\u015fmedeki borcun aynen ifa edilmesinden vazge\u00e7erek m\u00fcspet(olumlu) zararlar\u0131n\u0131n kar\u015f\u0131lanmas\u0131n\u0131 talep hakk\u0131,<\/strong><\/p>\n<p>\u2013\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>S\u00f6zle\u015fmeden d\u00f6nerek menfi zararlar\u0131n\u0131n kar\u015f\u0131lanmas\u0131n\u0131 isteme hakk\u0131.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Eserin Zaman\u0131nda Teslim Edilmemesi Halinde i\u015f sahibinin s\u00f6z konusu haklar\u0131 \u015fu \u015fekildedir :<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u0130n\u015faat\u0131n Teslimini ve Gecikme Tazminat\u0131n\u0131 Y\u00fckleniciden \u0130steme Hakk\u0131<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>\u0130n\u015faat\u0131n kararla\u015ft\u0131r\u0131lan tarihte teslim edilmemesi durumunda arsa ya da yap\u0131 sahibi kural olarak m\u00fcteahhitten in\u015faat\u0131n teslimini talep edebilecektir.<\/p>\n<p>Arsa ya da yap\u0131 sahibinin in\u015faat s\u00f6zle\u015fmesinden kaynaklanan in\u015faat tesliminin ifas\u0131n\u0131 beklemek y\u00f6n\u00fcnde tercihte bulunmas\u0131 halinde, gecikilen d\u00f6nem i\u00e7in m\u00fcteahhitten gecikme tazminat\u0131 isteme hakk\u0131 bulunmaktad\u0131r.<\/p>\n<p>Y\u00fcklenici i\u015fle i\u015f sahibi aras\u0131nda gecikme tazminat\u0131 kararla\u015ft\u0131r\u0131lm\u0131\u015fsa, kararla\u015ft\u0131r\u0131lan tutar y\u00fcklenici taraf\u0131ndan i\u015f sahibine \u00f6denir.<\/p>\n<p>Taraflar s\u00f6zle\u015fmede gecikme tazminat\u0131 kararla\u015ft\u0131rmam\u0131\u015f olsalar bile i\u015f sahibi rayi\u00e7 bedeller \u00fczerinden gecikme tazminat\u0131 talep edebilir.<\/p>\n<p>\u0130\u015f sahibi gecikme tazminat\u0131n\u0131 zamana\u015f\u0131m\u0131 s\u00fcresi i\u00e7inde talep edebilecektir.<\/p>\n<p>Taraflar eser s\u00f6zle\u015fmesiyle i\u015fin ge\u00e7 tesliminden dolay\u0131 ve ge\u00e7 teslim s\u00fcresinin b\u00fct\u00fcn\u00fc i\u00e7in tazminat -cezai \u015fart- \u00f6demeyi kabul etmi\u015f oldu\u011funa g\u00f6re bunu davac\u0131ya eksiksiz olarak \u00f6demek zorundad\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u0130\u015f Sahibi Eserin Tesliminden Vazge\u00e7erek Olumlu Zarar\u0131n\u0131n Kar\u015f\u0131lanmas\u0131n\u0131 \u0130steme Hakk\u0131<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Y\u00fcklenicinin in\u015faat\u0131n tesliminde gecikmesi halinde, i\u015f sahibi eserin tesliminden vazge\u00e7erek zararlar\u0131n\u0131n kar\u015f\u0131lanmas\u0131n\u0131 istedi\u011fini bildirebilir.<\/p>\n<p>Bildirim y\u00fcklenici taraf\u0131ndan taahh\u00fct s\u00fcresinin bitiminden hemen sonra yap\u0131lmal\u0131d\u0131r.<\/p>\n<p>Bildirim yap\u0131lmas\u0131 ile y\u00fcklenicinin sorumlulu\u011fu bir miktar paran\u0131n \u00f6denmesi anlam\u0131na gelen tazminat borcuna d\u00f6n\u00fc\u015f\u00fcr.<\/p>\n<p>Tazminat miktar\u0131, s\u00f6zle\u015fmedeki in\u015faat ediminin yerine getirilmemesinden do\u011fan zararlar\u0131n tamam\u0131n\u0131 kapsayacak tutarda olmal\u0131d\u0131r.<\/p>\n<p>Olumlu zarar\u0131n kar\u015f\u0131lanmas\u0131, malvarl\u0131\u011f\u0131nda \u015fayet s\u00f6zle\u015fme ifa edilseydi ger\u00e7ekle\u015fecek art\u0131\u015f ile mevcut durumdaki fark\u0131n maddi tutar\u0131 kadar paran\u0131n \u00f6denmesi anlam\u0131na gelmektedir.<\/p>\n<p>\u00d6rne\u011fin arsa sahibi s\u00f6zle\u015fme uyar\u0131nca 20 Nisan 2019\u2019da in\u015faat\u0131n bitece\u011fini hesap ederek bir daireyi 3. bir ki\u015fiye 750.000 TL\u2019ye satm\u0131\u015f, ancak in\u015faat\u0131n zaman\u0131nda bitirilememesinden \u00f6t\u00fcr\u00fc s\u00f6zle\u015fme feshedilmi\u015fse, bu durumda arsa sahibi bu sat\u0131\u015f\u0131n iptal olmas\u0131ndan kaynaklanan zarar\u0131n\u0131n tazmin edilmesini m\u00fcteahhitten isteyebilecektir.<\/p>\n<p>Fakat bu noktada e\u011fer alacakl\u0131, borcun zaman\u0131nda veya kararla\u015ft\u0131r\u0131lan yerde ifa edilmemesine ra\u011fmen, hi\u00e7bir \u00e7ekince ileri s\u00fcrmeden ifay\u0131 kabul ederse art\u0131k cezai \u015fart\u0131n \u00f6denmesini isteyemeyecek olup bu hakk\u0131ndan z\u0131mnen feragat etmi\u015f say\u0131lacakt\u0131r.<\/p>\n<p>BK madde 27 dikkate al\u0131narak cezai \u015fart\u0131n, y\u00fcklenicinin ekonomik \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc yok edecek veya a\u011f\u0131r \u015fekilde k\u0131s\u0131tlayacak derecede y\u00fcksek olmas\u0131 halinde ahlaka ayk\u0131r\u0131l\u0131k te\u015fkil edece\u011finden bu hususta de\u011ferlendirilerek belirli bir d\u00fczeye indirilebilmesi m\u00fcmk\u00fcnd\u00fcr<\/p>\n<p>Bu kapsamda i\u015f sahibinin in\u015faat tamamlanm\u0131\u015f olsayd\u0131 bunlardan elde edece\u011fi kira bedelleri, gecikme cezas\u0131, i\u015f\u00e7ilik ve malzeme bedeli, in\u015faat\u0131n teslim tarihindeki sat\u0131m de\u011feri ile ilerleyen zamanda teslim edilmi\u015fse bu tarihteki sat\u0131m de\u011feri aras\u0131ndaki fark, kullan\u0131m de\u011feri kayb\u0131 gibi zararlar\u0131n\u0131 olumlu zarar kapsam\u0131nda y\u00fckleniciden istemek m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>M\u00fcspet zarar i\u015f sahibinin s\u00f6zle\u015fmeden vazge\u00e7ti\u011fi an itibariyle hesaplan\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u0130\u015f Sahibinin Eser S\u00f6zle\u015fmesinden D\u00f6nme ve Olumsuz Zararlar\u0131n\u0131 \u0130steme Hakk\u0131<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Arsa ya da yap\u0131 sahibi, s\u00f6zle\u015fmeden d\u00f6nme hakk\u0131n\u0131 kullanmak istiyorsa, y\u00fckleniciye in\u015faat\u0131 teslim i\u00e7in verdi\u011fi s\u00fcrede de in\u015faat\u0131n teslim edilmemesi halinde, s\u00fcrenin bitiminde derhal bildirimde bulunmal\u0131d\u0131r.<\/p>\n<p>S\u00f6zle\u015fmeden d\u00f6n\u00fclmesi halinde, s\u00f6zle\u015fme yap\u0131ld\u0131\u011f\u0131 tarihten itibaren ge\u00e7ersizle\u015ftirildi\u011finden, daha \u00f6nce verilmi\u015f \u015feylerin iadesini gerektirmektedir.<\/p>\n<p>S\u00f6zle\u015fmeden d\u00f6nme hakk\u0131n\u0131 kullanan i\u015f sahibi, menfi zarar denilen ve s\u00f6zle\u015fmenin ge\u00e7ersiz olmas\u0131ndan kaynaklanan zararlar\u0131n tazminini de talep edebilmektedir.<\/p>\n<p>Menfi zarar s\u00f6zle\u015fmenin yerine getirilece\u011fine duyulan inanc\u0131n bo\u015fa \u00e7\u0131kmas\u0131ndan kaynaklanan zararlar\u0131 ifade etmektedir.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Eseri Ba\u015fkas\u0131na Tamamlatarak Masraf Ve Zararlar\u0131n \u00d6denmesini Talep Hakk\u0131<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>\u0130\u015f sahibine tan\u0131nan in\u015faat\u0131 zarar ve masraflar\u0131 y\u00fckleniciye ait olmak \u00fczere ba\u015fkas\u0131na tamamlatma hakk\u0131 Bor\u00e7lar Kanunu\u2019nun 113. maddesinde d\u00fczenlenmi\u015ftir.<\/p>\n<p>\u0130lgili maddeye g\u00f6re, y\u00fcklenicinin yapma borcunu yerine getirmemesi halinde, alacakl\u0131 masraflar\u0131 y\u00fckleniciye ait olmak \u00fczere in\u015faat\u0131n kendisi veya ba\u015fkas\u0131 taraf\u0131ndan yap\u0131m\u0131na izin verilmesini isteyebilir.<\/p>\n<p>\u0130\u015f sahibi izin talep ederken avans mahiyetinde bir mebla\u011f\u0131n masraflar i\u00e7in kendisine \u00f6denmesini de isteyebilir.<\/p>\n<p>Dilerse de masraflar\u0131 daha sonra a\u00e7aca\u011f\u0131 bir alacak davas\u0131yla da talep edebilir.<\/p>\n<p>Nama ifaya izin olarak da bilinen in\u015faat\u0131 tamamlama ya da ba\u015fkas\u0131na tamamlatma izni, mahkemeden talep edilmektedir.<\/p>\n<p>\u0130\u015fin tamamlanmas\u0131 i\u00e7in gereken t\u00fcm masraflar mahkemenin atayaca\u011f\u0131 bilirki\u015fi taraf\u0131ndan tespit
