Bu nedenle, Canayd\u0131n Hukuk B\u00fcrosu olarak bu konuda mevzuat h\u00fck\u00fcmleri \u00e7er\u00e7evesinde bir yaz\u0131 haz\u0131rlad\u0131k.<\/p>\n<p>T\u00fcrk Bor\u00e7lar Kanunu'nun 343. maddesine g\u00f6re kira s\u00f6zle\u015fmelerinin kirac\u0131 aleyhine revize edilmesi yasakt\u0131r. Ancak istisnai olarak kira bedelinin revize edilmesi m\u00fcmk\u00fcnd\u00fcr. Bu d\u00fczenleme ile kirac\u0131n\u0131n haklar\u0131 korunurken, malikin de haklar\u0131n\u0131n ihlal edilmesinin \u00f6n\u00fcne ge\u00e7ilebilmektedir.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Kira art\u0131\u015f oran\u0131n\u0131n taraflar aras\u0131nda belirlendi\u011fi haller:<\/u><\/strong><\/p>\n<p>Kira s\u00f6zle\u015fmesinin yenilenme d\u00f6nemleri i\u00e7in taraflar kendi aralar\u0131nda, T\u00dc\u0130K (T\u00fcrkiye \u0130statistik Kurumu) taraf\u0131ndan her ay a\u00e7\u0131klanan T\u00fcketici Fiyat Endeksi'ni (T\u00dcFE) a\u015fmayan bir kira art\u0131\u015f oran\u0131 belirleyebilirler. T\u00fcrk Bor\u00e7lar Kanunu'nun 344. maddesine g\u00f6re, taraflar\u0131n kira art\u0131\u015f oran\u0131 konusunda anla\u015fmalar\u0131, ancak anla\u015ft\u0131klar\u0131 oran T\u00dc\u0130K'in \u201c12 ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131\u201dn\u0131 ge\u00e7medi\u011fi takdirde ge\u00e7erlidir. T\u00dc\u0130K'e g\u00f6re T\u00dcFE'de \u201c12 ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131\u201d \u015eubat ay\u0131nda 25,98 olup, bu oran Mart ay\u0131nda yenilenecek s\u00f6zle\u015fmeler i\u00e7in kira art\u0131\u015f oran\u0131d\u0131r. Dolay\u0131s\u0131yla taraflar T\u00dcFE'den daha y\u00fcksek bir oran \u00fczerinde anla\u015f\u0131rlarsa bu tutar dikkate al\u0131nmayacak ve kira art\u0131\u015f oran\u0131 T\u00dcFE'ye e\u015fit olacakt\u0131r. \u00d6rne\u011fin Mart 2022'de taraflar kira art\u0131\u015f oran\u0131 olarak 30,98'de anla\u015f\u0131rlarsa %5'i dikkate al\u0131nmayacak ve kira art\u0131\u015f oran\u0131 25,98 olacakt\u0131r.<\/p>\n<p>Sonu\u00e7 olarak, T\u00dcFE'den daha y\u00fcksek bir kira art\u0131\u015f\u0131 oran\u0131 belirlemek m\u00fcmk\u00fcn de\u011fildir ve kiraya verenin T\u00dcFE'den fazla bir miktar talep etmesi halinde, kirac\u0131 bu miktar\u0131 \u00f6demek zorunda de\u011fildir ve mal sahibi bu nedenle dava a\u00e7amaz veya kirac\u0131y\u0131 tahliye edemez.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Kira art\u0131\u015f oran\u0131n\u0131n taraflar aras\u0131nda belirlenmedi\u011fi haller:<\/u><\/strong><\/p>\n<p>Taraflar, kira s\u00f6zle\u015fmesini yaparken bir kira art\u0131\u015f oran\u0131 belirlemek zorunda de\u011fildir. Taraflar, bir kira art\u0131\u015f oran\u0131 belirlemedikleri hallerde, kira bedelinin belirlenmesini hakimden talep ederek dava a\u00e7abilirler. Bu durumda hakim T\u00dcFE oran\u0131na g\u00f6re bir kira bedeli belirler. Ancak kira s\u00f6zle\u015fmesi 5 y\u0131ldan fazla bir s\u00fcredir devam ediyor ise hakim sadece T\u00dcFE oran\u0131n\u0131 de\u011fil, ayn\u0131 zamanda m\u00fclk\u00fcn durumunu ve \u00e7evredeki benzer m\u00fclklerin kira bedellerini de dikkate al\u0131r.<\/p>\n<p>Bu dava, kira s\u00f6zle\u015fmesinin yenilenmesinden en az 30 g\u00fcn \u00f6nce veya mal sahibi, kira art\u0131\u015f\u0131 talebini bu 30 g\u00fcn i\u00e7inde kirac\u0131ya yaz\u0131l\u0131 olarak bildirirse, t\u00fcm kiralama s\u00fcresi boyunca a\u00e7\u0131lmal\u0131d\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Ola\u011fan\u00fcst\u00fc durumlarda kira art\u0131\u015f\u0131:<\/u><\/strong><\/p>\n<p>Kira s\u00f6zle\u015fmesinin yap\u0131lmas\u0131 s\u0131ras\u0131nda taraflarca \u00f6ng\u00f6r\u00fclmeyen ancak sonradan meydana gelen ola\u011fan\u00fcst\u00fc durumlarda, s\u00f6zle\u015fmenin ifas\u0131 bir taraf i\u00e7in olduk\u00e7a g\u00fc\u00e7le\u015fmi\u015f ise, ifada g\u00fc\u00e7s\u00fczl\u00fc\u011fe d\u00fc\u015fen taraf kira s\u00f6zle\u015fmesinin uyarlanmas\u0131n\u0131 mahkemeden isteyebilir. Kira bedelinin uyarlanmas\u0131 davalar\u0131nda hakim yeni kira bedelini belirlerken T\u00dcFE ile ba\u011fl\u0131 de\u011fildir ve mevcut ko\u015fullara g\u00f6re bir de\u011ferlendirme yapar.<\/p>\n<p>Bu duruma, COVID-19 salg\u0131n\u0131 s\u00fcresince kiralar\u0131n\u0131 \u00f6demekte g\u00fc\u00e7l\u00fc\u011fe d\u00fc\u015fen ve bu nedenle kira bedelinin uyarlanmas\u0131 davas\u0131 a\u00e7an kirac\u0131lar \u00f6rnek g\u00f6sterilebilir.<\/p>\n<p>Bununla birlikte; deprem, sel, sava\u015f, ekonomik krizler ve hatta deval\u00fcasyonlar gibi durumlar, toplumun tamam\u0131n\u0131 veya b\u00fcy\u00fck bir k\u0131sm\u0131n\u0131 etkileyen ola\u011fan\u00fcst\u00fc durumlar olarak nitelendirilir. Yarg\u0131tay; salg\u0131n hastal\u0131k, sava\u015f, do\u011fal afet gibi olaylar\u0131n, s\u00f6zle\u015fme taraflar\u0131n\u0131n ifa g\u00fc\u00e7l\u00fc\u011f\u00fcne d\u00fc\u015fmesine sebep olabilecek olaylar olarak de\u011ferlendirildi\u011fini belirtmi\u015ftir.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00d6zetlemek gerekirse; taraflar aras\u0131nda kira art\u0131\u015f oran\u0131n\u0131n belirlendi\u011fi durumlarda, T\u00dc\u0130K taraf\u0131ndan a\u00e7\u0131klanan bir \u00f6nceki y\u0131l\u0131n 12 ayl\u0131k ortalamalar\u0131na g\u00f6re belirlenen T\u00dcFE oran\u0131n\u0131 a\u015fmayacak \u015fekilde taraflar\u0131n kararla\u015ft\u0131rd\u0131klar\u0131 kira art\u0131\u015f oran\u0131 dikkate al\u0131nmaktad\u0131r.  Taraflar aras\u0131nda kira art\u0131\u015f oran\u0131n\u0131n belirlenmedi\u011fi durumlarda kira bedeli, kira tespit davas\u0131 ile h\u00e2kim taraf\u0131ndan belirlenebilmektedir.
