Kira borcunu \u00f6demeyen kirac\u0131lar\u0131n tahliye edilmesi i\u00e7in mevzuatta baz\u0131 hukuki y\u00f6ntemler belirlenmi\u015f olup, bu s\u00fcre\u00e7ler genel olarak uzun s\u00fcrd\u00fc\u011f\u00fcnden kiraya verenlerin ma\u011fduriyeti ortaya \u00e7\u0131kmaktad\u0131r. Kira \u00f6demeyen kirac\u0131n\u0131n tahliye edilmesi i\u00e7in icra yoluna ba\u015fvurmak m\u00fcmk\u00fcnd\u00fcr. Bu hususta kiraya verenler kiras\u0131n\u0131 \u00f6demeyen kirac\u0131ya dava a\u00e7madan do\u011frudan tahliye talepli icra takibi ba\u015flatabilir.<\/p>\n<p>Kirac\u0131 taraf\u0131ndan kira bedeli zaman\u0131nda \u00f6denmedi\u011finde kiralayan\u0131n, alaca\u011fa kavu\u015fmak ve kirac\u0131y\u0131 tahliye etmek i\u00e7in ba\u015fvurabilece\u011fi bir\u00e7ok yol vard\u0131r. Alacak i\u00e7in icra takibi ba\u015flat\u0131labilir veya alacak davas\u0131 a\u00e7abilir. Kirac\u0131n\u0131n tahliyesi i\u00e7in ise iki hakl\u0131 ihtar \u00e7ekip Sulh Hukuk Mahkemesi\u2019nde genel h\u00fck\u00fcmler do\u011frultusunda tahliye davas\u0131 a\u00e7abilir. Ancak kirac\u0131n\u0131n tahliyesi ve alaca\u011f\u0131n birbirinden ba\u011f\u0131ms\u0131z olarak y\u00fcr\u00fct\u00fclmesi hem s\u00fcreci uzataca\u011f\u0131ndan hem de maliyeti art\u0131raca\u011f\u0131ndan dolay\u0131 \u0130cra ve \u0130flas Kanunu\u2019nda hem kira alaca\u011f\u0131n\u0131n hem de kirac\u0131n\u0131n tahliyesini ayn\u0131 anda y\u00fcr\u00fct\u00fclebilmesini sa\u011flayan Adi Kiraya ve Has\u0131lat Kiralar\u0131na \u0130li\u015fkin icra takibi di\u011fer ad\u0131yla \u00d6rnek No-13 Tahliye \u0130htarl\u0131 \u00d6deme Emri yolu d\u00fczenlenmi\u015ftir.<\/p>\n<p><strong>1-Tahliye Talepli Ba\u015flat\u0131lan \u0130cra Takibi<\/strong><\/p>\n<p>Bor\u00e7lu kirac\u0131 s\u00f6zle\u015fme \u015fartlar\u0131na g\u00f6re \u00f6deme g\u00fcn\u00fc gelen kiray\u0131 \u00f6demezse, kiraya veren kirac\u0131ya kar\u015f\u0131 tahliye istemli icra takibi ba\u015flatabilir ve bu yolla kiran\u0131n \u00f6denmesini ve kirac\u0131n\u0131n tahliyesini talep edebilir. Kira bedelini \u00f6demeyen kirac\u0131n\u0131n tahliyesi i\u00e7in, 2004 say\u0131l\u0131 \u0130cra ve \u0130flas Kanunu\u2019nun 269 ve devam\u0131 maddeleri gere\u011fi tahliye talepli icra takibi ba\u015flatmak h\u0131zl\u0131 ve pratik bir yol olmas\u0131 a\u00e7\u0131s\u0131ndan uygulamada en \u00e7ok tercih edilen tahliye y\u00f6ntemidir.<\/p>\n<p><strong>Tahliye Talepli Ba\u015flat\u0131lan \u0130cra Takibi S\u00fcreci:<\/strong><\/p>\n<p>\u0130cra dairesi taraf\u0131ndan kirac\u0131ya kira bedellerinin \u00f6denmesi ama\u00e7l\u0131 ve tahliye talepli \u00f6deme emri g\u00f6nderilir. Bu \u00f6deme emrinin kirac\u0131ya tebli\u011f edilmesinin ard\u0131ndan kirac\u0131 a\u00e7\u0131s\u0131ndan 7 ve 30 g\u00fcnl\u00fck iki s\u00fcreden kaynakl\u0131 hukuki s\u00fcre\u00e7 takip edilir.<\/p>\n<p>\u00d6ncelikle kirac\u0131; \u00f6deme emrinin tebli\u011finden itibaren 7 g\u00fcn i\u00e7erisinde \u00f6denmemi\u015f kira bedellerini \u00f6deyebilir ya da borcu olmad\u0131\u011f\u0131 iddias\u0131 ile \u00f6deme emrine itiraz edebilir. S\u00f6z konusu \u00f6deme emrine 7 g\u00fcn i\u00e7erisinde itiraz edilmedi\u011fi durumunda, kirac\u0131 30 g\u00fcn i\u00e7erisinde icra takibine konu toplam borcu t\u00fcm masraflar\u0131 ile birlikte \u00f6demez ise, mal sahibi \u0130cra Hukuk Mahkemesi\u2019nde kirac\u0131n\u0131n tahliyesi i\u00e7in dava a\u00e7ar. E\u011fer icra takibindeki borca itiraz edilmi\u015fse, itiraz\u0131n kald\u0131r\u0131lmas\u0131 talebine de ayn\u0131 dilek\u00e7e de yer verir. Bu davan\u0131n di\u011fer tahliye davas\u0131ndan fark\u0131, borcun \u00f6denmedi\u011finin tespiti ile ilk duru\u015fmada sona ermesinin m\u00fcmk\u00fcn olmas\u0131 ve duru\u015fma g\u00fcn\u00fcn\u00fcn yak\u0131n tarihe verilmesidir. Di\u011fer t\u00fcr tahliye davalar\u0131nda, ilk duru\u015fma g\u00fcn\u00fc misal, 7 ay sonraya verilirken, icra takibinin devam\u0131 olan tahliye davas\u0131nda 1 ay sonraya duru\u015fma g\u00fcn\u00fc verilebilmektedir.<\/p>\n<p>\u015eayet kirac\u0131, 30 g\u00fcn i\u00e7erisinde t\u00fcm takip masraflar\u0131 da dahil olmak \u00fczere kira bedelini \u00f6derse ise, tahliye edilemez. Ancak, bir sonraki gecikme de tekrar tahliye talepli icra takibi ba\u015flat\u0131labilme hakk\u0131n\u0131z bakidir.<\/p>\n<p>Di\u011fer bir deyi\u015fle, kirac\u0131 \u00f6deme emrinin tebli\u011finden itibaren 30 g\u00fcn i\u00e7erisinde ta\u015f\u0131nmaza ait kira bedelini \u00f6demeli ya da ta\u015f\u0131nmaz\u0131 tahliye etmelidir. Bahsi ge\u00e7en s\u00fcrelerin sonunda, kirac\u0131 kira bedellerini \u00f6demez ve \u00f6deme emrine itiraz etmezse; belirtilen 30 g\u00fcnl\u00fck s\u00fcre sonunda a\u00e7\u0131lacak bir dava sonucunda  icra dairesi kanal\u0131 ile ta\u015f\u0131nmazdan tahliye edebilecektir. T\u00fcm bu s\u00fcre\u00e7, gerek\u00e7eli karara itiraz edilmemesi halinde 4 ile 6 ay kadar s\u00fcrmektedir.<\/p>\n<p>\u00d6zetlemek gerekir ise; 7 g\u00fcnl\u00fck s\u00fcre itiraz s\u00fcresi olup kirac\u0131n\u0131n ta\u015f\u0131nmazdan tahliye edilebilmesi i\u00e7in mutlaka 30 g\u00fcnl\u00fck s\u00fcrenin dolmas\u0131 gerekir. Bor\u00e7lu kirac\u0131 30 g\u00fcnl\u00fck s\u00fcrenin tamam\u0131nda hem kira bedellerini \u00f6demez, hem de ta\u015f\u0131nmaz\u0131 tahliye etmez ise, \u0130cra Hukuk Mahkemesi\u2019nde a\u00e7\u0131lacak dava ile,  kiralanan ta\u015f\u0131nmaz icra dairesi taraf\u0131ndan tahliye edilir.<\/p>\n<p><strong>2-Temerr\u00fct Sebebi ile Tahliye Davas\u0131n\u0131n \u0130kame Edilmesi<\/strong><\/p>\n<p>TBK\u2019n\u0131n 315. maddesi gere\u011fi, kirac\u0131n\u0131n temerr\u00fcd\u00fc nedeniyle kira s\u00f6zle\u015fmesinin sona erdirilmesi m\u00fcmk\u00fcnd\u00fcr. Kirac\u0131n\u0131n \u00f6demesi gereken kira bedelini ya da yan giderleri \u00f6dememesi halinde, kiraya veren yaz\u0131l\u0131 olarak kirac\u0131ya s\u00fcre vererek bu s\u00fcre i\u00e7erisinde borcunu \u00f6demesi gerekti\u011fini, aksi halde kira s\u00f6zle\u015fmesinin feshedece\u011fini bildirebilir. Kirac\u0131ya verilecek bu s\u00fcrenin \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda en az 30 g\u00fcn, di\u011fer kiralarda ise en az 10 g\u00fcn olmas\u0131 zorunludur ve bu s\u00fcre, kirac\u0131ya yaz\u0131l\u0131 bildirimin yap\u0131ld\u0131\u011f\u0131 tarihi izleyen g\u00fcnden itibaren i\u015flemeye ba\u015flar.<\/p>\n<p>Kirac\u0131 ihtarnamenin tebli\u011f edilmesinden itibaren yukar\u0131da verilen s\u00fcreler i\u00e7erisinde geciken kira bedelini \u00f6demez ise kirac\u0131ya kar\u015f\u0131, kira d\u00f6neminin sonu beklenmeden temerr\u00fct nedeni ile tahliye davas\u0131 ikame edilebilir. Dava sonucunda verilen tahliye karar\u0131 ise icra m\u00fcd\u00fcrl\u00fc\u011f\u00fc arac\u0131l\u0131\u011f\u0131 ile sonu\u00e7land\u0131r\u0131labilir. Kirac\u0131, yukar\u0131da belirtilen s\u00fcreler i\u00e7erisinde \u00f6deme yaparsa tahliye davas\u0131 ikame edilemeyecektir. TBK\u2019n\u0131n 315. maddesinin hem konut veya \u00e7at\u0131l\u0131 i\u015fyerleri kira s\u00f6zle\u015fmelerinde hem de adi kira s\u00f6zle\u015fmelerinde uygulanmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p><strong>3-\u0130ki Hakl\u0131 \u0130htar \u00c7ekilmesi ve Akabinde Tahliye Davas\u0131 A\u00e7\u0131lmas\u0131yla Kirac\u0131n\u0131n Tahliyesi<\/strong><\/p>\n<p>TBK\u2019n\u0131n 352. maddesinin 2. f\u0131kras\u0131na g\u00f6re; kirac\u0131, kira borcunu \u00f6demeyerek ya da ge\u00e7 \u00f6deyerek bir kira y\u0131l\u0131 i\u00e7erisinde kendisine iki hakl\u0131 ihtarda bulunulmas\u0131na neden olursa; kiraya veren kirac\u0131 aleyhine tahliye davas\u0131 a\u00e7abilir. Bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde ise, kiralama s\u00fcresi i\u00e7inde bu \u015fartlar\u0131n ger\u00e7ekle\u015fmesi halinde tahliye davas\u0131 a\u00e7\u0131labilir. (Belirtilmelidir ki, kirac\u0131n\u0131n kira bedelini ge\u00e7 \u00f6demesi durumlar\u0131nda ihtarnamenin kirac\u0131n\u0131n bedeli \u00f6demesinden \u00f6nce tebli\u011f edilmi\u015f olmas\u0131 \u00f6nem arz eder.)<\/p>\n<p>S\u00fcre\u00e7te kiraya veren \u00f6ncelikle, farkl\u0131 aylara dair muaccel kira alacaklar\u0131na dair ayr\u0131 ayr\u0131 iki yaz\u0131l\u0131 ihtar\u0131 kirac\u0131ya bildirmelidir. Bu ihtarlar\u0131n tebli\u011f edilmesinin ard\u0131ndan, kiraya verenin ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer Sulh Hukuk Mahkemesi\u2019ne ba\u015fvurarak tahliye davas\u0131 a\u00e7abilmesi m\u00fcmk\u00fcnd\u00fcr. Tahliye davas\u0131n\u0131n iki hakl\u0131 ihtar\u0131n g\u00f6nderildi\u011fi kira d\u00f6neminin bitiminden itibaren bir ay i\u00e7erisinde a\u00e7\u0131lmas\u0131 gerekmekte olup bu s\u00fcre hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcredir. TBK\u2019n\u0131n 352. maddesinin sadece konut veya \u00e7at\u0131l\u0131 i\u015fyeri kira s\u00f6zle\u015fmelerinde uygulanmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p><strong>Tahliye S\u00fcreci ve \u0130\u015flemler<\/strong><\/p>\n<p>S\u00fcre\u00e7 i\u00e7erisinde yap\u0131lan itirazlar \u00fczerine mahkeme, a\u00e7\u0131lan davan\u0131n t\u00fcr\u00fcne g\u00f6re itiraz\u0131n iptaline ya da itiraz\u0131n kald\u0131r\u0131lmas\u0131na h\u00fckmedebilir. Bor\u00e7lu, verilen bu h\u00fckme kar\u015f\u0131 istinaf yoluna gidebilecektir. \u015eayet, bor\u00e7lunun istinaf talebi de reddedilirse ve kira borcu Yarg\u0131tay\u2019a ba\u015fvurma s\u0131n\u0131r\u0131n\u0131n alt\u0131nda kal\u0131yorsa, tahliye karar\u0131 kesinle\u015fir. Verilen mahkeme h\u00fckm\u00fc \u00fczerine ta\u015f\u0131nmaz cebri icra yolu ile tahliye edilir.<\/p>\n<p>Tahliye karar\u0131n\u0131n kesinle\u015fmesinin ard\u0131ndan uygulamada icra m\u00fcd\u00fcrl\u00fc\u011f\u00fc kirac\u0131ya ta\u015f\u0131nmaz\u0131 tahliye etmesi i\u00e7in 15 g\u00fcnl\u00fck s\u00fcre verir ve kirac\u0131, s\u00f6z konusu s\u00fcre i\u00e7erisinde tahliyeyi ger\u00e7ekle\u015ftirmezse cebri icra yoluyla tahliye edilece\u011finin ihtar\u0131n\u0131 yapar. 15 g\u00fcnl\u00fck s\u00fcre i\u00e7erisinde kirac\u0131 tahliyeyi ger\u00e7ekle\u015ftirmezse icra memuru e\u015fli\u011finde tahliye i\u015flemi ger\u00e7ekle\u015ftirilir.<\/p>\n<p>Kirac\u0131 15 g\u00fcnl\u00fck s\u00fcre i\u00e7inde m\u00fclk\u00fc bo\u015faltmazsa, icra memuru e\u015fli\u011finde tahliye i\u015flemi ger\u00e7ekle\u015ftirilir.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u0130lgili Kanun Maddeleri<\/strong><\/p>\n<p><strong>6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu MADDE 315- Kirac\u0131, kiralanan\u0131n tesliminden sonra muaccel olan kira bedelini veya yan gideri \u00f6deme borcunu ifa etmezse, kiraya veren kirac\u0131ya yaz\u0131l\u0131 olarak bir s\u00fcre verip, bu s\u00fcrede de ifa etmeme durumunda, s\u00f6zle\u015fmeyi feshedece\u011fini bildirebilir.  Kirac\u0131ya verilecek s\u00fcre en az on g\u00fcn, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda ise en az otuz g\u00fcnd\u00fcr. Bu s\u00fcre, kirac\u0131ya yaz\u0131l\u0131 bildirimin yap\u0131ld\u0131\u011f\u0131 tarihi izleyen g\u00fcnden itibaren i\u015flemeye ba\u015flar.<\/strong><\/p>\n<p><strong>6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu MADDE 352\/2- Kirac\u0131, bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde; bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelini \u00f6demedi\u011fi i\u00e7in kendisine yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarda bulunulmas\u0131na sebep olmu\u015fsa kiraya veren, kira s\u00fcresinin ve bir y\u0131ldan uzun s\u00fcreli kiralarda ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak bir ay i\u00e7inde, dava yoluyla kira s\u00f6zle\u015fmesini sona erdirebilir.<\/strong><\/p>\n<p><strong>2004 Say\u0131l\u0131 \u0130cra ve \u0130flas Kanunu Madde 269- Takip adi kiralara veya has\u0131lat kiralar\u0131na m\u00fctedair olur ve alacakl\u0131 da talep ederse \u00f6deme emri, Bor\u00e7lar Kanununun 260 ve 288 inci maddelerinde yaz\u0131l\u0131 ihtar\u0131 ve kanuni m\u00fcddet ge\u00e7tikten sonra icra mahkemesinden bor\u00e7lunun kiralanan \u015feyden \u00e7\u0131kar\u0131lmas\u0131 istenebilece\u011fi tebli\u011fini ihtiva eder.<\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>The owner of the property owners in the position of the tenant&#8217;s greatest problem faced is the eviction of the tenants and the collection of rent receivables.
