T\u00fcrk Bor\u00e7lar Kanunu (TKH) ve \u0130cra ve \u0130flas Kanunu (\u0130HK), m\u00fclk sahibini \u00f6deme yapmayan kirac\u0131ya kar\u015f\u0131 korumak i\u00e7in h\u0131zl\u0131 ve etkili y\u00f6ntemler \u00f6ng\u00f6rmektedir. Bu y\u00f6ntemlerin en yayg\u0131n ve pratik olan\u0131, \u00d6rnek No: 13 Tahliye Talebi ile \u0130cra \u0130\u015flemi ve bu i\u015flemin sonu\u00e7 vermemesi durumunda ba\u015flat\u0131lacak Tahliye Davas\u0131 s\u00fcrecidir. Bu yaz\u0131da, kira alaca\u011f\u0131n\u0131n tahsili ve kirac\u0131n\u0131n tahliyesi i\u00e7in izlenmesi gereken yasal ad\u0131mlar\u0131 ayr\u0131nt\u0131l\u0131 olarak inceleyece\u011fiz.<\/p>\n<p>13 numaral\u0131 \u00f6rnekteki y\u00fcr\u00fctme prosed\u00fcr\u00fc nedir?<\/p>\n<p>\u00d6rnek No: 13, halk aras\u0131nda \u201ctahliye talebiyle birlikte icra takibi\u201d olarak bilinen, \u0130cra ve \u0130flas Kanunu&#039;nun 269. ve sonraki maddelerinde d\u00fczenlenmi\u015f, haciz ve tahliyenin ayn\u0131 anda talep edildi\u011fi, h\u00fck\u00fcm verilmeden icra takibinin \u00f6zel bir y\u00f6ntemidir. Bu y\u00f6ntemin en b\u00fcy\u00fck avantaj\u0131, uzun s\u00fcren genel mahkeme s\u00fcre\u00e7lerini beklemeden, \u0130cra Medeni Mahkemeleri arac\u0131l\u0131\u011f\u0131yla \u00e7ok daha h\u0131zl\u0131 bir \u015fekilde tahliye karar\u0131 al\u0131nmas\u0131na olanak sa\u011flamas\u0131d\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00d6rnek 13&#039;ten \u00f6nce uyar\u0131 mektubu g\u00f6ndermek zorunlu mu?<\/p>\n<p>Ev sahiplerinin en \u00e7ok kafas\u0131n\u0131 kar\u0131\u015ft\u0131ran konulardan biri, icra i\u015flemine ba\u015flamadan \u00f6nce noter arac\u0131l\u0131\u011f\u0131yla bir uyar\u0131 mektubu g\u00f6ndermenin zorunlu olup olmad\u0131\u011f\u0131d\u0131r. \u00d6rnek No: 13&#039;teki icra i\u015fleminde, \u00f6nceden uyar\u0131 mektubu g\u00f6nderme zorunlulu\u011fu yoktur; icra dairesi arac\u0131l\u0131\u011f\u0131yla g\u00f6nderilen \u00f6deme emri, yasal olarak uyar\u0131 mektubunun yerini al\u0131r. Bu nedenle, noter masraflar\u0131na katlanmadan ve zaman kaybetmeden s\u00fcreci do\u011frudan icra dairesi arac\u0131l\u0131\u011f\u0131yla ba\u015flatmak en pratik y\u00f6ntemdir.<\/p>\n<p>&nbsp;<\/p>\n<p>\u0130cra \u0130\u015flemi S\u00fcreci ve Yasal S\u00fcreler (7 ve 30 G\u00fcnl\u00fck Kural)<\/p>\n<p>\u0130cra dairesi arac\u0131l\u0131\u011f\u0131yla ba\u015flat\u0131lan i\u015flem sonucunda kirac\u0131ya bir \u201c\u00d6deme Emri\u201d g\u00f6nderilir. Konut ve kapal\u0131 i\u015f yeri kiralar\u0131 i\u00e7in g\u00f6nderilen bu \u00f6deme emrinde kirac\u0131ya iki \u00f6nemli yasal s\u00fcre tan\u0131n\u0131r:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>\u0130tiraz S\u00fcresi (7 G\u00fcn):<\/strong> Avrupa Kredi Kanunu&#039;nun 269. maddesi uyar\u0131nca, kirac\u0131, \u00f6deme emrinin kendisine tebli\u011f edilmesinden itibaren 7 g\u00fcn i\u00e7inde borca, faize veya kira s\u00f6zle\u015fmesine itiraz edebilir. \u0130tiraz edilmesi halinde, icra i\u015flemi durdurulur.<\/li>\n<li><strong>\u00d6deme S\u00fcresi (30 G\u00fcn):<\/strong> Kirac\u0131, s\u00f6z konusu i\u015fleme itiraz etmezse veya itiraz etse bile (itiraz\u0131n kald\u0131r\u0131lmas\u0131 i\u00e7in a\u00e7\u0131lacak davaya halel getirmeksizin), Avrupa Kira Kanunu&#039;nun 269. maddesine at\u0131fta bulunularak T\u00fcrk Ticaret Kanunu&#039;nun 315. maddesi uyar\u0131nca, tebligat tarihinden itibaren 30 g\u00fcn i\u00e7inde, i\u015fleme konu kira borcunu t\u00fcm ek masraflar\u0131yla (faiz, giderler vb.) birlikte \u00f6demek zorundad\u0131r.<\/li>\n<\/ul>\n<p>Kirac\u0131n\u0131n Olas\u0131 Hareketleri ve Anla\u015fman\u0131n Niteli\u011fi<\/p>\n<p>S\u00fcrecin nas\u0131l ilerleyece\u011fi, kirac\u0131n\u0131n \u00f6deme emrine verece\u011fi tepkiye ve kira s\u00f6zle\u015fmesinin \u015fekline ba\u011fl\u0131d\u0131r:<\/p>\n<ul>\n<li><strong>Kirac\u0131 borcunu 30 g\u00fcn i\u00e7inde \u00f6derse:<\/strong> \u00d6deme gecikmesi (temerr\u00fct) s\u00f6z konusu olmayaca\u011f\u0131ndan tahliye davas\u0131 a\u00e7\u0131lamaz. Ancak bu durum, ev sahibine &quot;\u0130ki Hakl\u0131 Uyar\u0131 Nedeniyle Tahliye Davas\u0131&quot; a\u00e7mak i\u00e7in ilk uyar\u0131 olarak kullanma hakk\u0131 verir.\u201c<\/li>\n<li><strong>Kirac\u0131 7 g\u00fcn i\u00e7inde itiraz ederse:<\/strong> \u0130\u015flem durur. Bu noktada, anla\u015fman\u0131n yaz\u0131l\u0131 m\u0131 yoksa s\u00f6zl\u00fc m\u00fc oldu\u011fu \u00f6nem kazan\u0131r:\n<ul>\n<li><strong>Yaz\u0131l\u0131 bir kira s\u00f6zle\u015fmesi varsa:<\/strong> Kirac\u0131 imzay\u0131 inkar etmezse, m\u00fclk sahibi, EBL&#039;nin 269\/c maddesi uyar\u0131nca \u0130cra Hukuk Mahkemesinde h\u0131zl\u0131 sonu\u00e7lanan &quot;\u0130tiraz\u0131n Kald\u0131r\u0131lmas\u0131 ve Tahliye&quot; davas\u0131 a\u00e7abilir.<\/li>\n<li><strong>S\u00f6zl\u00fc Anla\u015fma Varsa (Veya \u0130mza Reddedilmi\u015fse):<\/strong> \u0130cra Mahkemesinin yetki alan\u0131 s\u0131n\u0131rl\u0131 oldu\u011fundan, tan\u0131k dinleyemez. Ev sahibi, daha uzun bir s\u00fcre\u00e7 olan &quot;Tahliye \u0130tiraz\u0131n\u0131n ve Tahliyenin \u0130ptali&quot; davas\u0131n\u0131 Sulh Ceza Mahkemesinde a\u00e7mal\u0131d\u0131r.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Kirac\u0131 itiraz etmez ve 30 g\u00fcn i\u00e7inde \u00f6deme yapmazsa:<\/strong> \u0130cra i\u015flemi kesinle\u015fir; ev sahibi, Avrupa Konut Kanunu&#039;nun 269\/a maddesi h\u00fckm\u00fc uyar\u0131nca do\u011frudan tahliye davas\u0131 a\u00e7ma hakk\u0131n\u0131 kazan\u0131r.<\/li>\n<\/ul>\n<p>Kirac\u0131n\u0131n &quot;K\u0131smi \u00d6deme&quot; Tuza\u011f\u0131: Eksik \u00d6deme Tahliyeyi Engeller mi?<\/p>\n<p>Uygulamada s\u0131k\u00e7a kar\u015f\u0131la\u015f\u0131lan durumlardan biri, kirac\u0131n\u0131n 30 g\u00fcnl\u00fck yasal s\u00fcre i\u00e7inde yaln\u0131zca ana kira bedelini \u00f6demesi ve tahakkuk eden faizi, icra masraflar\u0131n\u0131 veya avukatl\u0131k \u00fccretini \u00f6dememesidir. Y\u00fcksek Mahkeme kararlar\u0131 bu konuda son derece a\u00e7\u0131kt\u0131r: Tahliyeden ka\u00e7\u0131nmak i\u00e7in kirac\u0131n\u0131n icra emrinde belirtilen t\u00fcm tutarlar\u0131 eksiksiz olarak \u00f6demesi zorunludur. Ana kira bedeli 30 g\u00fcnl\u00fck s\u00fcre i\u00e7inde \u00f6dense bile, icra masraflar\u0131n\u0131n veya faizin 1 TL bile eksik \u00f6denmesi, temerr\u00fct durumunu ortadan kald\u0131rmaz ve ev sahibine \u0130cra Mahkemesinde tahliye davas\u0131 a\u00e7ma hakk\u0131 verir.<\/p>\n<p>&nbsp;<\/p>\n<p>\u0130cra Hukuk Mahkemesinde Tahliye Davas\u0131<\/p>\n<p>Kirac\u0131, 30 g\u00fcnl\u00fck \u00f6deme s\u00fcresinin dolmas\u0131na ra\u011fmen borcunu tam olarak \u00f6demezse, m\u00fclk sahibi \u0130cra Mahkemesine ba\u015fvurarak kirac\u0131n\u0131n tahliyesini talep edebilir.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Dava A\u00e7ma S\u00fcresi S\u0131n\u0131r\u0131:<\/strong> EBL&#039;nin 269\/a maddesi uyar\u0131nca, tahliye davas\u0131, 30 g\u00fcnl\u00fck \u00f6deme s\u00fcresinin bitiminden itibaren 6 ay i\u00e7inde a\u00e7\u0131lmal\u0131d\u0131r. Bu s\u00fcre, zamana\u015f\u0131m\u0131 s\u00fcresidir (hak kayb\u0131 s\u00fcresi).<\/li>\n<li><strong>Arabuluculuk \u0130stisnas\u0131:<\/strong> 1 Eyl\u00fcl 2023 tarihinden itibaren kira ihtilaflar\u0131nda arabuluculuk zorunlu hale gelmi\u015f olsa da, icra i\u015flemleri yoluyla ba\u015flat\u0131lan (\u00d6rnek 13) ve \u0130cra Hukuk Mahkemesinde a\u00e7\u0131lan itiraz\u0131n kald\u0131r\u0131lmas\u0131 ve tahliye davalar\u0131 arabuluculuk \u015fart\u0131na tabi de\u011fildir. M\u00fclk sahibi do\u011frudan dava a\u00e7abilir (Ancak Sulh Hukuk Mahkemesindeki davalar arabuluculu\u011fa tabidir).<\/li>\n<li><strong>Duru\u015fma ve Karar:<\/strong> Mahkeme resmi bir inceleme yapar; \u00f6deme emrinin usule uygun olarak bildirilip bildirilmedi\u011fini ve \u00f6demenin tamam\u0131n\u0131n belirlenen s\u00fcre i\u00e7inde yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131 kontrol ederek tahliye karar\u0131 verir.<\/li>\n<\/ul>\n<p>Tahliye s\u00fcreci ortalama ne kadar s\u00fcrer?<\/p>\n<p>Kirac\u0131n\u0131n itiraz edip etmemesine ve mahkemelerin i\u015f y\u00fck\u00fcne ba\u011fl\u0131 olarak s\u00fcrecin uzunlu\u011fu de\u011fi\u015fmekle birlikte, ortalama s\u00fcre \u015fu \u015fekildedir:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>\u0130cra i\u015flemlerinin ba\u015flat\u0131lmas\u0131 ve bildirim s\u00fcreci: 1-3 hafta<\/li>\n<li>Yasal \u00f6deme s\u00fcresini beklemek: 30 g\u00fcn<\/li>\n<li>\u0130cra Hukuk Mahkemesi&#039;ndeki dava s\u00fcreci: 3-6 ay<\/li>\n<li>Karar\u0131n uygulanmas\u0131 ve fiili tahliye: 1-2 ay<\/li>\n<\/ul>\n<p>Usul hatas\u0131 yap\u0131lmad\u0131\u011f\u0131 takdirde, tahliye i\u015flemi ortalama 5-8 ay i\u00e7inde tamamlanabilir.<\/p>\n<p>&nbsp;<\/p>\n<p>Karar\u0131n Uygulanmas\u0131 ve Ger\u00e7ek Tahliye S\u00fcreci<\/p>\n<p>Mahkeme tahliye karar\u0131 verdikten sonra, kirac\u0131 ta\u015f\u0131nmaz\u0131 derhal bo\u015faltmazsa, zorla tahliye a\u015famas\u0131 ba\u015flar. Tahliye karar\u0131 icra dairesine iletildikten sonra, kirac\u0131ya bir icra emri g\u00f6nderilir. Karar\u0131n tebli\u011finden itibaren yasal s\u00fcre dolduktan sonra, ta\u015f\u0131nmaz, icra memurlar\u0131 e\u015fli\u011finde (gerekirse \u00e7ilingir ve kolluk kuvvetleri de dahil olmak \u00fczere) fiilen bo\u015falt\u0131l\u0131r ve m\u00fclk sahibine teslim edilir.<\/p>\n<p>&nbsp;<\/p>\n<p>Sonu\u00e7<\/p>\n<p>Avrupa Konut Kanunu&#039;nun 269. maddesi uyar\u0131nca kira \u00f6demeyen kirac\u0131ya kar\u015f\u0131 ba\u015flat\u0131lan 13. \u00d6rnek icra i\u015flemi, m\u00fclk sahiplerine kanunun sundu\u011fu en etkili ara\u00e7lardan biridir. Ancak bu s\u00fcre\u00e7, bildirim kanununa uyulmas\u0131, s\u00fcrelerin s\u0131k\u0131 bir \u015fekilde takip edilmesi ve do\u011fru mahkemeye do\u011fru taleplerle ba\u015fvurulmas\u0131 gibi kat\u0131 \u015fekil \u015fartlar\u0131na tabidir.
