Entry Bans and Restriction Codes

Entry Bans to Türkiye, Restriction Records and the Legal Avenues That May Apply

A decision imposing an entry ban to Türkiye on a foreign national, or the creation of a restriction record, may directly affect entry into Türkiye, visas, residence and other foreigners law procedures.

In every file, the reason for the entry ban or restriction code, the administrative act on which it is based, its duration and the foreign national's current legal situation must be examined separately. Because the same code or record may be linked to different events and administrative assessments, it is not correct to draw a definite legal conclusion merely from the name of the code.

Canaydın Law Firm provides services in the examination of the legal status of entry bans to Türkiye and of the Ç, G, N, V and other restriction records, administrative applications, the assessment of the possibility of a visa with a special annotation, and, where necessary, the conduct of litigation.

In Which Situations Can Entry Bans and Restriction Codes Arise?

01 — Entry Ban to Türkiye

An entry ban to Türkiye is an administrative act that prevents a foreign national from entering Türkiye for a certain period or within the scope of a legal situation.

Violations of lawful stay, deportation procedures, assessments relating to public order or public security, and other grounds provided for in the legislation may be linked to an entry ban.

It is not possible to correctly determine the legal avenue to follow without establishing the reason for and basis of the ban.

02 — Restriction Codes

Restriction records in the Ç, G, N, V and other groups may exist for foreign nationals with the Migration Management authorities and the relevant authorities.

The legal effect of a restriction record may vary according to the type of code, the administrative act or information on which the record is based, and the foreign national's current situation.

For this reason, not only the name of the code but also the act on which it is based and the scope of the file should be examined together.

03 — Entry Ban Arising from a Violation of Lawful Stay

Overstaying the period of a visa, visa exemption, residence permit, work permit or work permit exemption may result in an entry ban to Türkiye, depending on the length of the violation and the manner of departure.

The length of the violation, whether the person departed voluntarily, whether a deportation decision exists against them, and the status of administrative fines must be assessed together.

04 — Entry Ban Linked to a Deportation Procedure

For foreign nationals against whom a deportation decision has been made or who have been deported, an entry ban to Türkiye and restriction records may additionally arise.

Because the legal status of the deportation decision and the entry ban or restriction record may be separate administrative acts, the decisions in the file must be examined together.

05 — Records Linked to Public Order and Public Security

Some entry bans and restriction records may be based on public order or public security assessments.

In such files, the basis of the record, the decisions notified to the foreign national, the existing administrative documents and the legal avenues that may apply must be examined specifically for the file.

06 — Records Identified at the Airport or Border Gate

When a foreign national arrives at a border gate to enter Türkiye, they may not be admitted to the country because of an existing entry ban or restriction record.

In this case, the procedure at the border gate, the INAD decision if any, the entry ban and the restriction record must be assessed together.

Is It Possible to Come to Türkiye While an Entry Ban Is in Place?

For foreign nationals who have an entry ban to Türkiye, depending on the nature of the file, the lifting of the entry ban, administrative or judicial avenues of appeal, or the possibility of a visa with a special annotation may come into play.

In Migration Management practice, persons who have an entry ban may be required, even if they are visa-exempt, to apply to Turkish diplomatic missions for a visa with a special annotation in order to enter Türkiye.

However, an application for a visa with a special annotation does not mean that permission to enter will definitely be granted. The outcome of the application is assessed by the competent authorities according to the reason for the entry ban and the applicant's situation.

How Are an Entry Ban and a Restriction Record Assessed?

  • The foreign national's passport and identity details
  • Entry and exit history to and from Türkiye
  • Violations of visa, residence or work permits
  • Deportation or INAD decisions, if any
  • Administrative decisions and documents notified to the foreign national
  • The legal and factual grounds on which the entry ban or restriction record is based
  • The purpose of re-entering Türkiye and existing family, work, education, medical treatment or other ties

A definite legal assessment should not be made merely on the basis of the restriction code or the length of the entry ban without seeing the existing documents in the file.

Administrative Application, Visa with a Special Annotation and Litigation

Administrative Application

Depending on the nature of the entry ban or restriction record, it may be possible to make an administrative application to the relevant authority for the record or decision to be reconsidered.

Visa with a Special Annotation

For foreign nationals who wish to come to Türkiye despite an entry ban for family, work, education, medical treatment or another special reason, the route of a visa with a special annotation may be assessed specifically for the file.

Annulment Action and Stay of Execution

If the administrative act based on the entry ban or restriction record is considered unlawful, the judicial avenues that may apply are examined separately, taking into account the nature of the decision and the status of its notification.
