Legal Review of Negative Decisions, Prior Hearings, Additional Document Requests and Long Delays in Visa and AIMA Files

Where a Portugal visa or residence application is refused, a possible negative decision is notified, an additional document request is received, or AIMA procedures remain unconcluded for a long time, the legal route to follow varies according to the type of file and the stage it is at.

Canaydın Law Firm provides services on the legal review of refusal or negative decision notifications, the preparation of the necessary explanations and supporting documents, the coordination of administrative and, where necessary, judicial processes with the authorized attorney in Portugal, and the assessment of the legal position of delayed AIMA files.

  • Review of the Grounds for Refusal
  • Audiência Prévia and the Administrative Process
  • AIMA Delays and Coordination with the Local Attorney

In Which Situations May a Legal Review Be Needed?

  • Refusal of D7, D8, D2, D6 or other Portugal visa applications
  • A request by the consulate for additional documents or explanations
  • Notification by AIMA of the possibility of a negative decision / a draft decision
  • Refusal of an AIMA residence permit or renewal application
  • An application remaining unconcluded despite exceeding the statutory or usual processing time
  • The residence card not being issued or delivered for a long time after the decision
  • An administrative dispute arising in family reunification, ARI / Golden Visa or other special files

A Refusal Decision Must First Be Reviewed on the File

After a negative decision, the first step is not merely to add new documents or to repeat the same application. The grounds for refusal, the documents submitted during the application, and the legal or factual point that the administration found insufficient must be examined together.

Review of the Decision and Its Grounds

The legal and factual grounds on which the refusal or negative decision notification is based are compared with the documents available in the file.

Identification of Missing or Contradictory Documents

The points in the income, accommodation, family tie, employment, investment, criminal record or other application documents that the administration may see as raising doubt are identified.

New Explanations and Supporting Documents

Depending on the stage of the file, a legal explanation, petition, statement and the necessary supporting documents are prepared.

Determination of the Appropriate Route of Application

Depending on the type of decision, the options of an administrative appeal, a response in the prior hearing, a new application or a judicial route are assessed together with the authorized attorney in Portugal.

Audiência Prévia – The Right to Be Heard Before a Negative Decision

Under Portuguese administrative law, subject to statutory exceptions, the person concerned has the right, before a final negative decision is issued, to be informed of the likely direction of the decision and to submit their views and documents. This stage is called "audiência prévia".

Under the General Administrative Procedure Code, this notification may be written or oral, and as a rule the person concerned is given a period of not less than 10 days to submit their views. The specific period given in the file must always be checked separately against the notification.

  • Review of the draft negative decision and its grounds
  • Preparation of explanations addressing factual or legal errors
  • Completion of documents found to be missing
  • Submission of new facts or documents to the file
  • Coordination of the response and strategy with the authorized attorney in Portugal

If a Visa Application Has Been Refused

In visa applications made for the purpose of residence in Portugal, the power to decide rests with the consular authority under the relevant legislation. In the event of refusal, the administrative or judicial route to follow must be determined according to the type of visa, the grounds for refusal, the content of the decision and the date of notification.

  • Review of the refusal decision and the consular file
  • Check of the appeal / lawsuit options and time limits stated in the decision
  • Assessment of the possibility of an administrative application with new documents or explanations
  • Assessment of whether a new visa application would be more appropriate
  • Where necessary, coordination of a judicial application with the authorized attorney in Portugal

The same route of appeal or the same time limit should not be assumed to apply in every refusal file. The current route is determined for the specific file on the basis of the decision letter and the application date.

If an AIMA Residence Permit or Renewal Application Has Been Refused

Under the Portuguese Foreigners Law, the refusal of a residence permit or renewal request must be notified to the applicant together with its grounds. The notification must also include information on how, and within what period, the decision can be challenged judicially.

  • Legal analysis of the AIMA refusal decision and its grounds
  • If an audiência prévia has been held, reassessment of the defense and documents submitted
  • Check of the documents on which the decision is based and of the current conditions
  • File-by-file review of the possibilities of administrative correction / reassessment
  • Coordination of the administrative court process with the authorized attorney in Portugal

If an AIMA File Has Remained Unconcluded for a Long Time

In delay files, merely establishing that "the application took a long time" is not sufficient. Whether the application is an initial residence, a renewal, a family reunification or a special category; whether the required documents were submitted in full; and whether the delay is attributable to the applicant are examined separately.

As of 2026, under the general regime, an initial residence permit application is expected to be decided within 90 days and a renewal application within 60 days. For renewal applications, the law provides for the consequence of tacit approval where the 60-day decision period is exceeded for reasons not attributable to the applicant. This consequence does not apply automatically to initial residence permit applications.

  • Determination of the type of application and the statutory decision period
  • Identification of the current stage of the AIMA file and the pending procedure
  • Check of whether there is a missing additional document / appointment / biometrics step
  • Preparation of a written application or request to be made to the administration
  • Where necessary, assessment of the administrative court route with the attorney in Portugal

Tacit Approval in Renewal Delays

The current provisions of the Portuguese Foreigners Law contain a special provision under which a renewal request is deemed approved if the renewal application is not concluded within the 60-day decision period for a reason not attributable to the applicant.

This provision does not apply to every delayed application or to initial residence permit requests. Whether the application is genuinely a renewal, whether the required documents have been completed, and whether the delay can be attributed to the applicant must be examined for the specific file.
