We Handle Your Investment and Your Citizenship Process Together

Overview

Clarifying the legal framework before the investment decision

Canaydın Law Firm handles the process from the legal assessment of the type of investment to the making of the investment, from the three-year no-sale annotation and three-year holding commitment procedures to the certificate of conformity, the investor residence permit and the Turkish citizenship application.

Real estate purchases, bank deposits, government debt instruments, the Private Pension System and other investment transactions can be carried out on the investor's behalf under a properly drawn power of attorney.

The spouse of the main investor and children under the age of 18 may also apply for Turkish citizenship under the main application, without making a separate investment.

Legal Assessment

Let us assess your investment process from a legal standpoint.

Your current situation can be reviewed with regard to the assessment of your investment option, the making of the investment, the certificate of conformity, the investor residence permit and the citizenship application.

Making the Investment

A power of attorney suited to the selected type of investment is prepared; the tax number, bank account and necessary investment documents are completed. The investment transactions are carried out on the investor's behalf, according to the scope of the power of attorney and the practice of the relevant authority.

  • Real Estate Investment — The legal and citizenship suitability of the property is reviewed; payment, currency and title deed procedures are completed, and the property is purchased on the investor's behalf by proxy.
  • Bank Deposit — The transfer of the investment amount to the bank account, the necessary currency transactions and the procedures for the commitment to hold the deposit for three years are carried out on the investor's behalf.
  • Government Debt Instruments — Instructions for the purchase of a suitable government debt instrument are prepared; the purchase and the three-year holding commitment procedures are carried out.
  • Private Pension System — The BES contract is established, the investment amount is transferred to the relevant funds and the three-year commitment to remain in the system is made.
  • Investment Funds — Participation shares of an eligible GYF or GSYF are purchased and a three-year citizenship block is established before the relevant authority.
  • Fixed Capital Investment — The company and investment documents are prepared, and the capital investment is made and established by the relevant authority.
  • Investment through Employment — Company and employee records are prepared, and the application to establish the requirement of employing at least 50 people is carried out.

Three-Year Holding Commitment and Certificate of Conformity

Once the investment has been made, a three-year no-sale annotation is placed on the real estate. For bank deposits and government debt instruments, a commitment is given that the investment will be held for three years; for investment funds, the requirement to hold for at least three years is fulfilled, and for BES investments, the requirement to remain in the system for three years. After these procedures, a certificate of conformity is requested from the relevant competent authority to establish that the investment complies with the citizenship legislation. Once the certificate of conformity is obtained, the investor residence permit and the Turkish citizenship application follow.

  • Real Estate Investment — After the title deed transfer, a three-year no-sale annotation is placed on the property.
  • Bank Deposit — The procedure is established whereby the deposit will be held at the bank for three years and the block will be maintained.
  • Government Debt Instruments — A commitment is given that the investment will be held for three years.
  • BES and Investment Funds — The requirement to remain in the system, or to keep the investment blocked and held, is fulfilled according to the type of investment.
  • Certificate of Conformity — An application is made to the relevant competent authority to establish that the investment complies with the citizenship legislation.

Which Procedures Can Be Carried Out Without Coming to Türkiye?

The process up to the making of the investment, the three-year no-sale annotation or three-year holding commitment procedures and the obtaining of the certificate of conformity can be carried out remotely with an appropriate power of attorney.

At the investor residence permit and citizenship application stage, the main investor and the spouse must be present in Türkiye to complete the necessary biometric and fingerprint procedures. Whether the children must be present in person is assessed according to their age and the practice of the relevant authority.

Applications of the Spouse and Children

The spouse of the main investor and children under the age of 18 may also apply for Turkish citizenship under the main investment, without making a separate investment.

  • Marriage documents
  • Birth documents of the children
  • Family registry documents
  • Ages of the children
  • Children from a previous marriage
  • In case of divorce, the divorce decree and custody documents
  • Consent of the other parent
  • Discrepancies in birth and marital status records
  • Apostille, certification, translation and notarization requirements for the documents

Files Already Started

For those who have already started their investment or citizenship procedures, the existing file can be reviewed and the remaining procedures carried out.

  • Reviewing whether the investment already made is suitable for citizenship
  • Checking the title deed, bank, BES, fund or investment documents
  • Completing missing certificate of conformity procedures
  • Identifying deficiencies in the residence or citizenship file
  • Responding to requests for additional documents
  • Following the file from its current stage
  • Assessing the legal avenues in case of refusal or a prolonged review

At the End of the Three-Year Period

Once the three-year investment period has been completed, the annotation on the title deed, the block on the bank or investment account and other commitment records are removed.

If the name and identity details in the bank, title deed, BES or investment account need to be updated after citizenship, these procedures are completed. Then, depending on the type of investment, the property can be sold, the deposit can be withdrawn or the investment instrument can be transferred.

FAQ

Frequently Asked Questions

How long does a Turkish citizenship by investment application take to conclude?

From the submission of the citizenship file to the relevant authority, applications are generally concluded in practice within 6 months to 1 year. The period may vary depending on the archive research, family documents, requests for additional documents and the workload of the administrative review. This period reflects the general assessment in practice; it is not a commitment to a definite conclusion.

Can I carry out the procedures without coming to Türkiye?

The procedures up to the making of the investment, the three-year no-sale annotation or three-year holding commitment and the certificate of conformity can be carried out remotely with an appropriate power of attorney. At the investor residence permit and citizenship stage, the main investor and the spouse must complete the necessary biometric procedures in Türkiye.

Can an attorney make my investment on my behalf?

Yes. With an appropriate power of attorney, real estate purchase and title deed transfer, bank deposits, purchases of government debt instruments, BES, investment funds, blocking and certificate of conformity procedures can be carried out on the investor's behalf.

Can I rent out the property I bought for citizenship?

Yes. The three-year annotation on the title deed restricts the sale or transfer of ownership of the property; it does not prevent the property from being rented out.

Do I have to live in the property I bought for citizenship?

No. There is no obligation to live in the property. The property can be used or rented out, provided that the three-year no-sale condition is observed.

Can any real estate be used in a citizenship application?

No. Not every property is suitable for a citizenship application. The type of the property, the nature of the title deed, the seller, the previous owner information and whether it has previously been used in a citizenship application must be reviewed. In addition, properties located in military prohibited zones or security zones, or in areas where acquisition by foreigners is restricted, may not be purchasable. Therefore, before any payment is made, the legal suitability of the property for citizenship and for acquisition by foreigners should be checked.

Can an application be made with more than one property?

Yes. In the purchase route, the required amount can be met with the total value of several properties. In the promise-of-sale route, however, the required amount must be covered within a single contract.

Can I benefit from the coupon income of the government debt instrument?

Yes. As long as the principal investment amount and the three-year block are maintained, you can benefit from the coupon or interest payments of the government debt instrument purchased.

Does a BES investment generate returns?

The BES contribution is placed in the selected pension funds. Depending on the performance of the funds, gains or losses in value may occur. For citizenship purposes, the three-year requirement to remain in the system must be maintained.

Can my spouse and children apply with the same investment?

Yes. The spouse of the main investor and children under the age of 18 can apply under the main investment, without making a separate investment.

If my citizenship application is rejected, can I get my investment back?

In case of a rejection decision, depending on the type of investment, steps can be taken to remove the annotation on the title deed, the block on the bank or investment account, or the relevant commitment. After the removal, the property can be sold, the deposit can be withdrawn or the investment instrument can be transferred. The administrative and judicial avenues available against the rejection decision are assessed separately.

After obtaining citizenship, can I withdraw my investment before three years have passed?

No. Even if the citizenship decision has been issued, the three-year requirement not to sell, not to withdraw, to hold or to remain in the system must not be violated before the period expires.

What happens when the three-year period is completed?

The title deed annotation, the block on the bank or investment account and other commitment records are removed. After the necessary name and identity updates are completed, the investment can be sold, withdrawn or transferred.
